These Terms & Conditions (the “Terms”) govern your use of the Home Portraits website and your purchase or commission of custom artwork, printed products, framed products, canvas products, and related services from Home Portraits (“Home Portraits,” “we,” “us,” or “our”). By using this website, submitting an order, uploading a photograph, approving a proof, or completing payment, you agree to these Terms.
1. Custom-made products
Our portraits are made to order from customer-supplied photographs and personalization details. Each commission is created specifically for the order and may include digital artwork, fine-art printing, matting, framing, canvas production, packaging, and fulfillment. Because these products are personalized, they cannot be restocked or resold in the same way as standard retail merchandise.
2. Customer photographs and permissions
You may upload only photographs and other materials that you own or have permission to use. By submitting an image, you represent and warrant that your use of the image for this commission does not infringe any copyright, privacy, publicity, contractual, or other rights of a third party.
Real-estate listing photographs may be owned by the photographer rather than the seller, buyer, agent, or brokerage. If you are unsure whether you have permission to use a listing photograph, use a photograph you took yourself or obtain permission from the rights holder before uploading it.
You grant Home Portraits and our production and technology providers a limited license to use the submitted materials only as reasonably necessary to create, proof, produce, fulfill, support, and maintain records relating to your order.
3. Artistic and generative process
Home Portraits creates an artistic interpretation of the source photograph. Our workflow may use proprietary generative, computer-assisted, photographic, illustration, retouching, and manual review processes. The goal is to preserve recognizable architectural features, perspective, and the character of the property while producing a cohesive watercolor-style work of art.
Minor artistic interpretation is inherent in the process. Landscaping, sky, incidental objects, small architectural details, color, texture, cropping, and background elements may be simplified, removed, softened, or adjusted when reasonably necessary for the composition.
4. Proofs, revisions, and approval
A digital proof is provided before a physical portrait is printed, framed, or produced on canvas. You are responsible for reviewing the proof carefully, including the home’s appearance, crop, spelling, family name, established year, and other personalization.
Reasonable refinement requests may be submitted before approval. Requests that materially change the original source image, replace the subject property, require a new composition, or substantially expand the original order may be treated as a new commission or may require an additional fee. We will disclose any additional charge before performing paid extra work.
Production begins only after you approve the proof. Approval may be given through the method we provide, including email or an online approval mechanism. Once approved, the proof is considered final for production, and changes may no longer be possible.
5. Customer responsibility for approved content
You are responsible for identifying errors before approving the proof. Home Portraits will correct errors caused by us. However, we are not responsible for spelling, dates, names, addresses, crop preferences, or other details that were visible in the proof and approved by you.
6. Cancellations
If you wish to cancel an order, contact us as soon as possible. We will make a reasonable effort to stop work that has not yet been completed. Because the artwork is custom-created, amounts attributable to artwork or services already performed may be nonrefundable.
After a proof has been approved and the physical product has entered production, the order cannot normally be canceled, changed, or refunded for a change of mind.
7. Pricing, payment, taxes, and shipping charges
Prices are shown in U.S. dollars unless otherwise stated. Product prices may change at any time before an order is placed. The price charged for an accepted order is the price shown at checkout, subject to correction of obvious typographical or technical errors.
Shipping charges are calculated from the delivery address, physical product configuration, and selected shipping service before payment and are included in the checkout total. Applicable sales or use taxes may also be added where required. Payment is processed by our third-party payment provider. You authorize us and our payment provider to charge the payment method you submit for the order total.
8. Production times and delivery estimates
Production and shipping timeframes are estimates, not guaranteed delivery dates. Custom artwork requires proof creation and customer approval before physical production can begin. Delays in proof approval will delay production.
Carrier delays, weather, holidays, supply interruptions, address problems, customs or regulatory issues, and other circumstances outside our reasonable control may affect delivery. We are not responsible for delays caused by a shipping carrier or events beyond our reasonable control, but we will assist with reasonable tracking or carrier inquiries.
9. Shipping addresses and delivery
You are responsible for providing a complete and accurate shipping address. Contact us immediately if an address needs to be corrected. Address changes are not guaranteed after an order has entered fulfillment or been transferred to a carrier.
If an order is returned because the address supplied was incorrect, incomplete, refused, or otherwise undeliverable for reasons not caused by us, additional shipping charges may apply before the item is resent.
10. Damage, defects, and incorrect orders
If your portrait arrives damaged, defective, or materially different from the approved proof because of our production error, contact us within 7 calendar days of delivery. Please keep the product and packaging and provide clear photographs of the item, frame, packaging, shipping label, and damage or defect so we can evaluate the claim.
When a claim is verified, our usual remedy is repair, replacement, or re-production at no additional product cost. If replacement is not reasonably available, we may issue an appropriate refund. We may require the damaged or incorrect item to be returned or made unavailable for use before a replacement or refund is issued.
11. Returns and refunds for personalized products
Because our products are personalized and made to order, we do not accept returns or provide refunds for buyer’s remorse, preference changes, an approved artistic choice, an approved crop, or an error that was visible in the proof and approved by the customer.
This policy does not limit your rights if the item is damaged, defective, incorrectly produced, or if applicable law provides a non-waivable remedy.
12. Natural material and production variation
Frames, mats, paper, canvas, inks, coatings, and other physical materials may have normal production variation. Natural-wood frames may differ in grain, tone, knots, or pattern. Printed color may also differ slightly from a backlit phone or computer screen because screens and physical print processes reproduce color differently.
Reasonable variations of this kind are not defects. Measurements may vary slightly because of trimming, matting, stretching, framing, and manufacturing tolerances.
13. Intellectual property
The Home Portraits website, branding, layout, copy, artwork examples, processes, designs, and other original content are owned by Home Portraits or our licensors and are protected by intellectual-property laws.
Purchasing a physical portrait transfers ownership of that physical item to you, but it does not transfer ownership of our underlying process, templates, website content, or other intellectual property. Unless a separate commercial license is provided in writing, commissioned artwork is intended for personal gifting, display, and ordinary noncommercial use.
14. Privacy and use of commissioned work
Our handling of personal information is described in our Privacy Policy. We do not claim permission to publicly display your source photograph, client name, or commissioned portrait in advertising solely because you placed an order. We may request separate permission if we would like to feature a commission in our portfolio, gallery, social media, or marketing.
15. Prohibited submissions and use
You may not use the website or our services to submit unlawful, infringing, fraudulent, threatening, defamatory, obscene, or malicious content, or content that violates another person’s rights. We may refuse or cancel an order if we reasonably believe the submitted material violates these Terms or applicable law.
16. Third-party services and fulfillment
We may use third-party providers for payment processing, hosting, file handling, printing, framing, canvas production, packaging, shipping, email, and other operational services. Those providers may process information necessary to perform their services. Their own terms and privacy practices may apply to their services.
17. Website availability and errors
We try to keep product descriptions, prices, images, and availability accurate, but errors can occur. We may correct typographical, pricing, technical, or product-information errors and may refuse or cancel an order affected by a material error. If we cancel an order after payment because of our error, we will refund the amount charged for the canceled order.
18. Disclaimer of warranties
To the fullest extent permitted by applicable law, the website and services are provided on an “as available” basis. Except for the express commitments stated in these Terms, we do not make additional warranties regarding uninterrupted website operation, exact screen-to-print color matching, carrier delivery times, or outcomes affected by the quality or limitations of a customer-supplied source image.
Nothing in these Terms excludes warranties, guarantees, or consumer rights that cannot lawfully be excluded.
19. Limitation of liability
To the fullest extent permitted by law, Home Portraits will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from use of the website or an order. Our aggregate liability for a claim relating to a particular order will not exceed the amount you paid to Home Portraits for that order.
These limitations do not apply where liability cannot legally be limited or excluded.
20. Indemnification
You agree to be responsible for claims, losses, or expenses arising from materials you submit in violation of these Terms, including claims that a photograph or other submitted content infringes a third party’s rights, to the extent permitted by applicable law.
21. Force majeure
We are not responsible for failure or delay caused by events beyond our reasonable control, including severe weather, natural disaster, fire, labor disruption, carrier interruption, supply shortage, widespread service outage, government action, war, terrorism, epidemic, or similar events.
22. Governing law and disputes
These Terms are governed by the laws applicable in the state in which Home Portraits is principally established, without regard to conflict-of-law principles, except where applicable consumer law requires otherwise. Before filing a formal claim, you agree to contact us and give us a reasonable opportunity to resolve the issue informally.
23. Changes to these Terms
We may update these Terms from time to time. The version posted on the website at the time an order is placed will generally govern that order. The “Last updated” date above indicates the most recent revision.
24. Severability and waiver
If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect to the fullest extent permitted by law. A failure to enforce a provision on one occasion does not waive the right to enforce it later.
